Der Deutsche Journalistenverband (DJV) hat heute seine schriftliche Stellungnahme zum Leistungsschutzrecht für Presseverlage veröffentlicht. Damit wird die Position des Verbands für die Anhörung im Rechtsausschuss des Bundestags am 30. Januar 2013 beschrieben. Das umfangreiche, kompetente und hoch detaillierte 40seitige Papier, unterzeichnet von DJV-Justiziar Benno H. Pöppelmann, wird hier zwecks Übersichtlichkeit nicht zur Gänze, sondern nur mit seinen einleitenden Thesen wiedergegeben. Zum Original auf der Verbandswebseite geht es hier entlang. An den vier Thesen und dem ausführlichen Papier lässt sich ablesen, dass der DJV das Leistungsschutzrecht für Presseverlage im Grundsatz für vorstellbar, wenn nicht sogar sinnvoll hält, den vorliegenden Gesetzesentwurf aber als zu kleinmütig, in Teilen unschlüssig formuliert und nicht weitreichend genug ansieht.
Das Papier beginnt mit einer Vorbemerkung:
Der vorliegende Gesetzentwurf hat bereits im Vorfeld der parlamentarischen Diskussion für erhebliches Aufsehen und viel Diskussion gesorgt. Der DJV hat sich an der Erörterung des Vorhabens, ein Leistungsschutzrecht für Verlage zu schaffen, beteiligt. Seine Vertreter haben Gespräche mit Verlegern und ihren Verbänden, mit den Fraktionen des Bundestages, den Kritikern und vor allem mit eigenen Mitgliedern geführt. Der Verbandstag des DJV hat sich seit 2009 jährlich mit dem Thema beschäftigt. Auf der Grundlage dieser intensiven Auseinandersetzung mit dem Thema wird die nachfolgende Stellungnahme abgegeben.
Dann folgenden die vier zentralen Positionspunkte des DJV:
1) Leistungsschutzrechte, so wie sie das deutsche Urheberrecht versteht, sollen entweder kreative Leistungen oder Investitionen in Werke und andere kreative Leistungen schützen.
2) Verleger haben im Gegensatz zu anderen Kulturunternehmen wie Sendeunternehmen oder Film- und Tonträgerproduzenten, kein eigenes Leistungsschutzrecht. Sie stützen ihre Rechtsposition ausschließlich auf von den Urhebern abgeleitete bzw. übertragene Rechte. Dass sie diese Rechte oftmals ausschließlich und umfassend erwerben (Buy out), führt zu nicht unerheblichen Problemen für die Autoren und Lichtbildner, die darauf mit der Forderung nach einer Stärkung des Urhebervertragsrechts reagieren.
3) Ein (auf Online-Nutzungen beschränktes) Leistungsschutzrecht nur für Verleger von Tageszeitungen und Zeitschriften, wie es der Gesetzentwurf vorsieht, führt zu rechtlichen Problemen, die vermieden werden können, wenn ein Leistungsschutzrecht für alle Verleger gesetzlich geregelt würde, das sie mit anderen Werkvermittlern gleichstellt. Gleichzeitig könnte die vertragliche Position der Urheber gestärkt werden.
4) Wenn lediglich ein Leistungsschutzrecht für Presseverleger eingeführt werden soll, sollte der vorliegende Entwurf eines 7. Gesetzes zur Änderung des Urheberrechtsgesetzes in einigen wesentlichen Punkten überarbeitet werden.
