Free Ride: Wie Google seine finanziellen Interessen durch Unterstützung der Wissenschaft absichert

Für einiges Aufsehen hat in den USA und Großbritannien Robert Levines Buch „Free Ride“ gesorgt, eine Widerrede gegen die Kostenloskultur im Internet und ein Plädoyer, funktionierende Märkte für kreative Güter zu schaffen. Levine ist ehemaliger Chefredakteur des Billboard Magazine. Beim Lesen ist mir das dritte Kapitel besonders aufgefallen: „Geeks bearing Gifts – Google’s War on Copyright“. Der Beitrag zeigt, wie systematisch Google durch Unterstützung von Wissenschaft, Forschung und privater Initiativen auf eine Änderung des Urheberrechts hinwirkt. Hier eine kurze Zusammenfassung des Kapitels mit einigen ergänzenden Anmerkungen.

Levines Beitrag beginnt mit dem 13. März 2007, der Tag, an dem Viacom YouTube wegen Urheberrechtsverletzungen auf mehr als eine Milliarde Dollar verklagte. YouTube argumentierte, durch den Digital Millennium Copy Act geschützt zu sein. Im Juni 2010 gab ein Bezirksgericht YouTube Recht; Viacom legte Berufung ein. Der Fall könnte zum Supreme Cout gehen und dessen Urteil, könnte entscheidend werden „für die Zukunft des Digital Millenium Copyright Act und vielleicht das Internet als Ganzes“, schreibt Levine.

Wie oberste amerikanische Gerichte das Urheberrecht auslegen, wird wichtige wirtschaftliche Auswirkungen auf die YouTube-Mutter Google haben. Wenn Google sich nicht mehr darauf berufen könnte, dass Nutzer geschütztes Material hochgeladen haben und die Plattform dafür nicht haftbar zu machen sei, kämen hohe Kosten auf das Unternehmen zu – zum Beispiel durch Überwachung der Uploads und oder durch den Einkauf von Rechten. (Anmerkung: Levines Schilderung des Sachverhalts ist nicht mehr auf dem neuesten Stand. Den aktuellen Stand des Verfahrens fasst zum Beispiel die International Business Times gut zusammen.)

Angesichts dieser Bedrohungen, argumentiert Levine, lohne es sich für Google, in „akademische Feuerkraft“ zu investieren, um ein gesellschaftliches Klima zu schaffen, das den eigenen wirtschaftlichen Interessen zuträglich ist. Deswegen habe Google schon am 28. November 2006, zwei Wochen nach dem Closing des YouTube-Kaufs, zwei Millionen Dollar an das Stanford Center for Internet and Society gespendet, das Rechtsprofessor Lawrence Lessig gegründet hatte und das er zum Zeitpunkt der Spende führte. Zwar akzeptiere das Zentrum keine Spenden, die an Sachzwecke gebunden sind, jedoch seien die Absichten des „Fair Use“-Projektes am Center for Internet and Society weitgehend identisch mit den wirtschaftlichen Interessen Googles: nämlich ein Gleichgewicht herzustellen „zwischen dem Recht, freien Zugang zu Informationen zu haben, und dem Recht des Eigentümers dieser Informationen“, wie es das Center for Internet and Society formuliert.

Seit dem großzügigen Start vor fünf Jahren habe sich die enge Beziehung zwischen Google und Lawrence Lessig für diesen mehr als bezahlt gemacht. So spendete Google 2008 1,5 Millionen Dollar an Creative Commons, die Initiative zur Vereinfachung von Nutzungsvereinbarungen im Internet. 2009 spendete Google-Mitgründer Sergej Brin gemeinsam mit seiner Frau Anne Wojcicki eine halbe Million Dollar an Creative Commons. Brins Schwiegermutter Esther Wojcicki sitze im Board of Directors. (Anmerkung: In Deutschland führen John Hendrik Weitzmann und Markus Beckedahl die Geschäfte von Creative Commons.) Ohne Zweifel setze sich Creative Commonsfür sinnvolle Zwecke ein, schreibt Levine, es sei aber nicht von der Hand zu weisen, dass diese Zwecke auch im massiven finanziellen Interesse von Google lägen.

Ausführlich schildert Levine den Kampf, den Lessig – auch finanziert durch Google – gegen das geltende Urheberrecht führt. Damit allein ließ Google es aber nicht bewenden. Google-Mitarbeiter spendeten 803.000 Dollar für Obamas Präsidentschaftswahlkampf, mehr als jede andere Firma, ausgenommen Goldman Sachs und Microsoft. Das Weiße Haus stellte mehrere Google-Mitarbeiter ein, darunter Andrew McLaughlin, den ehemaligen Google-Chef für Public Policy. (McLaughlin kehrte 2010 in die Wirtschaft zurück.)

Googles ehemaliger Chairman Eric Schmidt übernahm im Februar 2008 den Vorsitz des Boards der New America Foundation und spendete eine Million Dollar. Unter anderem finanziert die Stiftung eine „Open Technology Initiative“, die sich für offene Systeme einsetzt, wie sie in Googles wirtschaftlichem Interesse seien. Darüber hinaus spendet Google seit 1997 an das Berkman Center for Internet and Society der Harvard Law School, wovon unter anderem die Website „Chilling Effects“ unterstützt wird, die ein Register von Internet-Inhalten führt, die auf Initiative der Rechteinhaber gesperrt worden sind. Geld fließt auch an Public Knowledge, eine Initiative, die unter anderem für ein schwächeres Urheberrecht eintritt. Levine kommt zu dem Schluss, dass zwar auch andere amerikanische Unternehmen die Wissenschaft in ihre Richtung zu lenken versuchten, aber dass dies derzeit niemand das so entschlossen und konsequent tue wie Google.

Soweit die kurze Zusammenfassung des Kapitels.

Das Buch ist unter anderem von Business Week und dem Guardian besprochen worden. Während Business Week das Werk eher freundlich aufnahm, wirft der Guardian Levine vor, aus dem Blick zu verlieren, dass Google zwar für seine Interessen in der Wissenschaft eintrete, dass dies aber nicht zwangsläufig gegen das öffentliche Interesse gerichtet sein müsse. Auch der Öffentlichkeit müsse daran gelegen sein, freien Zugang zu Informationen zu genießen. Außerdem gäben auch die Filmstudios, Musikfirmen und Verlage Millionen für die Wahrung ihrer Interessen aus.

Die Einwände des Guardian sind zwar nachvollziehbar. Dennoch ist Levines Buch eine ratsame Lektüre für jeden, der sich mit Netzpolitik beschäftigt. Längst ist Google auch in Deutschland dazu übergegangen, die Wissenschaft mit seiner erprobten Methode zu vereinnahmen und Abhängigkeiten zu schaffen. Manchmal geschieht das sehr offen, wie etwa beim Forschungsinstituts für Internet und Gesellschaft in Berlin. Hier werden mit 4,5 Millionen Euro gestreckt auf drei Jahre Bindungen zu gleich mehreren wissenschaftlichen Zentren aufgebaut: Humboldt-Universität, Universität der Künste, Wissenschaftszentrum Berlin für Sozialforschung und Hans-Bredow-Institut in Hamburg.

Es darf darauf gewettet werden, dass in den nächsten Jahren zahlreiche Studien, Gutachten und Absolventen erscheinen werden, die gegen den Schutz des geistigen Eigentums eintreten und den freien, kostenlosen Zugriff auf kreative Schöpfungen verlangen. So wie es bei Googles Projekt Collaboratory heute schon geschieht. Auf diesem Wege wird ganz offen ein gesellschaftliches und akademisches Klima geschaffen, das Googles Milliardengewinne aus dem Suchmaschinenmonopol absichern hilft.

Nicht immer allerdings arbeitet Google so offen. Noch immer verweigern Google und die Initiative gegen ein Leistungsschutzrecht (IGEL), die Höhe der Google-Unterstützung bekannt zu geben. Mehrere Anfragen von Parlamentariern wurden abschlägig beschieden. In Brüssel verweist Google lediglich auf seinen Eintrag im Lobbyregister der EU. Die dort vermerkten Beiträge geben aber allenfalls die Personalkosten des Brüsseler Google-Büros wieder. Eine Aufschlüsselung des Geldes, die Google innerhalb der EU an Wissenschaft, Forschung und Initiativen schickt, ist längst überfällig, wenn Google seinen eigenen Anspruch auf Transparenz einlösen will. Dies wäre ein ideales Thema für Googles Transparency Report.

    Das ist allerdings ein überzeugendes Argument. :-) Allerdings vertritt Creative Commons auch keine Positionen, die für meine Firma wirtschaftlich von größter Bedeutung sind. Das ist einer von vielen Unterschieden zu Sergey Brin.
