Google sucht Copyright-Experten mit Sinn für Humor



Google, gefangen im Dauerstreit mit Kreativen, rüstet seine Rechtsabteilung in London auf und sucht per Anzeige Anwälte für Urheberrecht. Verhandelt wird mit den Kreativen und ihren Verlagen bekanntlich nicht, aber dafür werden mehr Juristen an Bord geholt. Um Google bei der Suche nach Experten zu unterstützen, erklärt sich dieser Blog bereit, den Text der Anzeige kostenlos weiter zu verbreiten, versehen mit einigen einführenden Bemerkungen:

Interessant an Googles Stellenausschreibung ist, wie das Unternehmen die anstehenden Herausforderungen sieht und sich selbst beschreibt. Gleich im ersten Satz wird ein Angriff auf das geltende Urheberrecht versprochen: „Gesetze des 20. Jahrhunderts lösen nicht unbedingt die Probleme des 21. Jahrhunderts“, heißt es da. Das meinen übrigens auch die Presseverlage und schlagen deshalb ein Leistungsschutzrecht vor. Wohl auch deswegen glaubt Google, der neue Kollege stünde bald vor den „härtesten juristischen Herausforderungen des Digitalzeitalters“. Wahrscheinlich ist das richtig. Kostenlos auf fremde Leistungen zugreifen zu wollen, wird auf Dauer wirklich zu einer harten juristischen Herausforderung, zumal jetzt auch die französischen Verlage offiziell beschlossen haben, ihrer Regierung ein Leistungsschutzrecht vorzuschlagen.

Geworben wird um Top-Juristen mit der Aussicht auf das Betreten juristischen Neulands, das Schaffen von Präzedenzfällen und das Finden kreativer Antworten. Ganz ausdrücklich gehört zur Aufgabe dazu, das „Digitalrecht nach vorn zu bringen“. Damit bringt Google ungewohnt deutlich zum Ausdruck, dass es auf eine Generalreform des Urheberrechts abzielt. Bisher hatte das Unternehmen diese Absicht eher versteckt, wie bei der vermeintlich ergebnisoffenen Diskussionsplattform Collaboratory.

Wichtige Charaktereigenschaft des neuen Google-Kollegen soll „Sinn für Humor“ sein. Nur zu verständlich, wenn es darauf ankommt, einerseits „Do no evil“ als Firmenmotto zu verteidigen und andererseits kostenlosen Zugriff auf die Arbeit von Kreativen durchzufechten.

In der abschließenden Selbstbeschreibung porträtiert sich Google als erfolgreiches Großunternehmen mit dem Startup-Gefühl von Gründern. Dann heißt es schwärmerisch: „Wir glauben an die Kraft der Technologie, die Welt zu verändern.“ Das ist ein hehres Ziel. Einstweilen geht es erst einmal darum, mit der Kraft von Juristen das Urheberrecht zu durchlöchern.

The role: Copyright Counsel

As Corporate Counsel at Google, you work on the most exciting legal issues as disruptive technological innovations require creative and proactive legal guidance. You’re part of a whip-smart group of in-house lawyers and the projects and cases you take on challenge you to think big and differently. You are collaborative — ready to partner in initiatives that influence all aspects of the business and work with Googlers from all over the company. As an integrated part of the team, you proactively assess legal risks and advise on products that will not only move information into the 21st century, but move information law forward as well.

As Copyright Counsel, you will work on an array of projects from high-level strategy setting to rapid response and breaking issues relating to litigation, Google’s products, and public messaging. You will be involved in substantial cross-group coordination with colleagues on the Policy, Corporate Communications and Product teams in addition to Litigation and Product Counsel within the Legal department. You will draw on your expertise in copyright law, sound judgement and awareness of current business and technology issues in the Internet space. Your creativity, quick-wittedness, sense of humour and the ability to work well with a team will be essential attributes for the role.

Responsibilities:

1. Establish and implement global strategy with a small team on copyright issues.

2. Shape public positions and framing messages and materials for use in advocacy on copyright issues.

3. Collaborate with in-house litigation team and outside lawyers on copyright amicus participation and Google’s own litigation, both in setting strategy and in close attention to arguments raised in briefing.

4. Engage with legal colleagues in advising Google on copyright issues and choices in its product development.

5. Monitor, research, and advise on emerging copyright issues.

Minimum Qualifications:

1. BA/BSc/LLB degree. In lieu of degree, relevant skills or equivalent experience.

2. EU qualified lawyer; facility with copyright laws of at least one civil and one common law jurisdiction. 

Preferred Qualifications:

1. Graduate degree (LL.M or equivalent) from an English or North American law school.

2. Familiarity with Internet technologies and the surrounding policy environments.

3. Ability to manage several simultaneous projects from inception to completion under deadline pressure.

4. High level of organisation, attention to detail and written and verbal communication skills.

5. Written and oral fluency in English. Additional European language(s); willingness to travel.

    Dem Thema LSR kann man sich nur noch mit viel Humor ernsthaft widmen.

    Das fehlen jedweder auch nur halbwegs rationalen Argumente für ein LSR verlieht dem Ansinnen ja bereits quasireligiöse Züge.

    Mit anderen Worten: eine konstante suchthafte Fokussierung auf Teilaspekte eines Ganzen ermöglicht die Bestätigung des beschränkten Konzepts über das selbige.
