(Text unten aktualisiert. Enthält jetzt Korrekturen von Fehlern in Lobos Spiegel-Kolumne) In seiner Spiegel Online-Kolumne wendet sich der Sascha (Enthüllung: Wir duzen uns irgendwie. Er hat mal mit meiner Frau studiert, glaube ich), also wendet sich der Sascha nun mir zu. Zitat:

Seitdem ich das gelesen habe, komme ich aus dem Grübeln nicht mehr heraus. Bin ich jetzt von höchster Stelle der Netzgemeinde entgegengesetzt? Oder ist es doch die Ironie? Oder eben beides, wie der Sascha meint? Wenn ich ein Ergebnis habe, melde ich mich. Bis dahin weiter Daten, Fakten und Meinungen zur Medienpolitik.
Nachtrag: Sascha Lobos Beitrag enthält Fehler und Fehleinschätzungen. Hier deswegen einige Richtigstellungen:
1. Die Befürworter des Leistungsschutzrechts wollen nicht das Netz ihren Geschäftsmodellen anpassen statt umgekehrt. Sie passen ihre Geschäftsmodelle dem Netz an und sind gerade deswegen darauf angewiesen, dass ihr Eigentum geschützt wird.
2. Subventionen sind selten sinnvoll. Deswegen haben die deutschen Verlage keine Subventionen beantragt. Es kam und kommt für sie nicht in Frage.
3. Die meisten Verlage haben im Netz nicht versagt, schon einmal gar nicht der Verlag, für den ich arbeite. Axel Springer erwirtschaftet mehr als 30 Prozent seiner Umsätze im Netz.
4. Die Verlage haben keine Hilfs-GEMA konstruiert. Ein Leistungsschutzrecht ist nicht automatisch an eine Verwertungsgeschaftspflicht gekoppelt. Verlage haben keine Verwertungsgesellschaftspflicht gefordert.
5. Das Leistungsschutzrecht konstituiert keine Staatshilfe, sondern setzt einen Rechtsrahmen.
6. WELT Kompakt hat den Abdruck von Tweets nicht mit Rücksicht auf ein Leistungsschutzrecht unterbrochen, sondern weil einzelne Twitterer Einspruch gegen die Verwendung ihrer Tweets erhoben hatte. In einem inaktiven Prozess mit der Twitter-Gemeinde ist inzwischen eine Lösung gefunden worden und es werden wieder Tweets gedruckt.
7. Axel Springer oder andere Verlage wussten im Vorfeld nichts vom Beschluss des Koalitionsausschusses zum Leistungsschutzrecht, geschweige denn kannte irgendjemand den Text.

Mein Hauptziel beim Presseschauder ist eigentlich eher, die Positionen der Verlage zu erläutern. Da ich intensiv an der Entwicklung dieser Positionen mitwirke, decken sie sich oft mit meiner persönlichen Meinungen. Ich finde es wichtig, dass solche Positionen nicht einfach nur in knappen Pressemitteilungen oder Forderungskatalogen verkündet werden, sondern dass die Protagonisten ihre Beweggründe erläutern und sich der Diskussion stellen. Das ist der Grund, warum ich mir hier die Mühe mache.
Konkret zu den Snippets: Nein, wegziehen von den Snippets möchte ich die Debatte nicht. Sie sind wichtig. Aber ich würde gern erreichen, dass auch die Vollaggregationen zur Kenntnis genommen werden. Sie sind nicht minder wichtig.
Was schutz- und vergütungswürdig ist, ist ein Thema dieses Blogs, aber nicht der Grund, warum ich den Blog als solchen betreibe. Siehe oben.

Ich hatte bereits ausgeführt, dass das Leistungsschutzrecht wohl kaum deswegen auf den Weg gebracht werden könne, weil Verlage nicht in der Lage sind, geltendes Recht durchzusetzen. Nur weil die Verlage den Überblick über ihr Rechtemanagement verloren haben, kann der Gesetzgeber nicht zur Seite springen und Steigbügelhalter für ein obsoletes Geschäftsmodell spielen.

Die Diskussion soll sich immer um die armen kreativen drehen, denen die böse Kostenlos-Kultur die Butter vom Brot zieht.
Sie sorgen dafür, das sich die Diskussionen schön im Kreis drehen und “schöne” Begriffe wie “Leistungsschutzrecht” (suggeriert eine erbrachte Leistung) und Urheberrecht (suggeriert kreatives Werken) im Focus stehen und nicht das “böse” Verwertungsrecht (suggeriert Abzocke).
Sie sind Lobbyist und machen Lobbyarbeit – auch im “Presseschauder”
