Frankreichs und Deutschlands Verlage haben beschlossen, ihre Interessen in der Urheberrechtspolitik künftig gemeinsam zu verfolgen und eng miteinander zu koordinieren. Die französischen Verleger haben überdies ihre Regierung offiziell ersucht, ein Leistungsschutzrecht einzuführen. Dies ist das Ergebnis einer Tagung, die gestern in Paris stattfand. Eingeladen hatte die Association de la Presse IPG, zu der das Syndicat de la Presse Quotidienne Nationale, das Syndicat des Editeurs des la Presse Magazine und das Syndicat de la Presse Quotidienne Régionale gehören. Diese Verbände haben gemeinsamen mit den deutschen Verlegerverbänden BDZV und VDZ folgende Erklärung herausgegeben:

Les éditeurs de presse en France et en Allemagne, à l’occasion d’une réunion commune organisée à Paris le 19 septembre, invitent leurs Gouvernements et leurs Parlements à soutenir les projets législatifs de droits voisins imaginés dans chacun des 2 pays.
Avec la décision du Gouvernement d’Angela Merkel de porter devant le Parlement allemand le projet de droits voisins, un grand Etat se donne, pour la 1ere fois, les moyens d’assurer la redistribution de la valeur captée aujourd’hui par les moteurs de recherche, au détriment des rédactions et des journalistes, et au détriment de la qualité de l’information des citoyens.
Parallèlement, les éditeurs français ont officiellement saisi le Gouvernement de M. Ayrault d’un dispositif législatif similaire. Ainsi se dessine une configuration politique historique, avec une démarche équivalente dans les 2 pays, parmi les plus puissants d’Europe, et susceptible de permettre enfin un développement économique équilibré entre les deux acteurs que sont la presse et les moteurs de recherche, tout en garantissant l’accès de tous à l’information.
La presse, qui a investi massivement dans l’économie digitale, est la principale source d’information des citoyens. Elle a gagné la bataille du numérique: les sites de presse sont leaders dans les pays européens et contribuent à l’information de publics de plus en plus nombreux et diversifiés. La presse remplit ainsi sa fonction d’intérêt général essentielle à la vitalité démocratique de nos sociétés.
Le partage équitable de la valeur sur le marché du digital s’impose, pour assurer la pérennité de la société de l’information, les investissements sur l’information en ligne, et l’accès de tous à l’information.
La protection par le droit voisin du droit d’auteur est une bonne solution, qui s’adosse à des principes juridiques historiques, et garants des libertés publiques et des droits individuels.
Les éditeurs français et allemands sont convenus de continuer leurs actions de concert.

Die Presseverleger in Frankreich und Deutschland fordern in einer koordinierten Aktion ihre Regierungen und Parlamente dazu auf, die gesetzlichen Vorhaben zur Einführung eines Leistungsschutzrechts für Presseverleger in beiden Ländern voranzutreiben.
Mit der Entscheidung der Deutschen Bundesregierung, dem Parlament einen Gesetzesentwurf für ein Leistungsschutzrecht für Presseverleger vorzulegen, hat zum ersten Mal ein großes europäisches Land den Grundstein dafür gelegt, die Verbreitung von Inhalten sicherzustellen, welche heute von Suchmaschinen und Aggregatoren zum Nachteil von
Redaktionen, Journalisten sowie der Leser ausgenutzt werden.
Zur gleichen Zeit haben die Französischen Verleger der Regierung M. Ayrault ein entsprechendes Modell für eine gesetzliche Regelung offiziell vorgelegt. Mit dem deckungsgleichen Vorgehen beider Länder bildet sich eine neuerliche politische Grundlage, in der zwei starke Kräfte Europas dafür eintreten, ein ökonomisches Gleichgewicht zwischen den beiden Akteuren Presse und Suchmaschinenanbieter / Aggregatoren herzustellen. Dies ist erforderlich, um den Zugang zu Informationen sicherzustellen.
Die Presse investiert in großem Maße in digitale Geschäftsmodelle und ist die wichtigste Informationsquelle der Bürger. Sie ist mit ihren digitalen Inhalten überaus erfolgreich: Online-Presseinhalte sind in beiden Ländern führend auf dem Markt der Informationen und tragen dazu bei, dass das Angebot öffentlich zugänglicher Informationen immer größer und vielfältiger wird. Die Presse erfüllt eine öffentliche Aufgabe, die für eine funktionierende Demokratie und eine lebendige Gesellschaft unabdingbar ist.
Für die Sicherstellung der Informationsgesellschaft, der Investitionen in den Online-Markt sowie des Zuganges zu Informationen ist eine gerechte Beteiligung der Presseverleger im Sinne des „Fair Share“ erforderlich. Dies ist ebenfalls notwendig, um ein Gleichgewicht zwischen den Inhalten und der Technologie sicherzustellen, denn die Presse wie auch Suchmaschinenanbieter brauchen einander.
Der Schutz durch das Leistungsschutzrecht innerhalb des bestehenden Urheberrechtsgesetzes ist eine gute Lösung, die sich an die Rechtssysteme beider Länder anlehnt und garantiert, sowohl die publizistische Freiheit als auch die Rechte einzelner zu wahren.
Die Französischen und Deutschen Presseverleger haben beschlossen, ihre Anstrengungen für den besseren Schutz ihrer Inhalte weiterhin gemeinsam zu verfolgen.

Fragen Sie mal die Veleger in Belgien, wer wen braucht

Die publizistische Freiheit haben Sie bereits jetzt und bezüglich des freud’schen Versprechers – es geht bloß um die Rechte Einzlener, also bloß von wenigen.
Wobei ja anzumerken ist, das diese Rechte, die es angeblich zu wahren gilt erst mittels eines LSP geschaffen werden.
btw – ein hervorragendes Werkzeug für den “Schutz” der Inhalte ist die robots.txt. Aber damit kann man halt nichts verkaufen …
