Verband Deutscher Lokalzeitungen fordert das Leistungsschutzrecht



Der Verband Deutscher Lokalzeitungen hat sich in einem Brief an Bundesjustizministerin Sabine Leutheusser-Schnarrenberger unmissverständlich für ein Leistungsschutzrecht ausgesprochen. Damit bekennen sich die Lokalzeitungen deutlich zu dem Gesetzesvorhaben der Regierung und widersprechen der „Initiative gegen ein Leistungsschutzrecht“ (IGEL), die mit einem Brandbrief versucht hatte, einen Keil zwischen große und kleine Verlage zu treiben. Dieser Versuch ist fehlgeschlagen. Mit seinem Brief, den der Verband heute per Pressemitteilung bekannt machte, erklären die kleineren Verlage deutlich, dass sie ein Leistungsschutzrecht für ebenso zwingend halten wie die großen. Die deutschen Lokalzeitungen begrüßen den Gesetzesentwurf für ein Leistungsschutzrecht für Presseverleger. Auch, wenn der Verband Deutscher Lokalzeitungen (VDL) nicht alle Forderungen der Verleger erfüllt sehe, so sei der Entwurf, der jetzt rasch ins parlamentarische Verfahren gehen müsse, ein erster wichtiger Schritt, heißt es in einem Schreiben von VDL-Geschäftsführer Martin Wieske an Bundesjustizministerin Sabine Leutheusser-Schnarrenberger.

Seit mehreren Jahren fordert der Verband Deutscher Lokalzeitungen die Einführung eines Leistungsschutzrechts für Presseverleger. „Auch die Lokalzeitungen erleben, dass im digitalen Zeitalter ihre Presseerzeugnisse umfassend kopiert werden, ohne dass den Verlagen ein eigenes Schutzrecht gegen diesen Missbrauch gegeben ist“, so Wieske.

Der jetzige Gesetzesentwurf enthalte Minimalvoraussetzungen, um Geschäftsmodelle zum Erhalt der Pressevielfalt gerade auch im lokalen Bereich zu entwickeln.

Der Entwurf sei einerseits von dem Bemühen getragen, den Verlagen ein Schutzrecht einzuräumen, auf der anderen Seite aber auch die in der Vergangenheit – aus Sicht der Presseverlage – geäußerte Kritik von anderer Seite zu berücksichtigen. Der Text beschränke sich daher auf einen sehr kleinen Ausschnitt von Verletzungshandlungen (öffentliche Zugänglichmachung) und Verletzern (gewerbliche Nutzer). Dass von interessierten Kreisen zu dem Entwurf trotzdem noch immer zum Teil vollkommen unsachliche Kritik und falsche Behauptungen geäußert würden, verwundere auch die Lokalzeitungsverleger.

      Ich glaube, Sie können davon ausgehen, dass der Verband für alle oder zumindest die allermeisten seiner Mitglieder spricht. Verbandsgeschäftsführer, die sich gegen die Interessen ihrer Mitglieder äußern, bleiben meist nicht mehr lange im Amt. Der VDL weiß schon genau, was er tut, denn die Argumente pro Leistungsschutzrecht sind auch für kleine Verlage bestechend.
